1. Acceptance of Terms
By accessing or using Swiftly, you agree to these Terms & Conditions ("Terms").
If you do not agree, do not use the platform.
2. Services
Swiftly provides no-code AI agents for chat and voice, integrations, and related features as outlined in your subscription plan.
3. Accounts
- You must provide accurate, complete, and updated information.
- You are responsible for maintaining account security.
- Misuse (fraud, abuse, illegal activity) may result in suspension or termination.
4. Subscriptions & Payments
- Plans: Freemium, Unlimited, Agency.
- Payments are processed securely via Stripe.
- Fees are non-refundable unless required by law.
- Usage fees (e.g., call minutes) are billed with an upcharge based on plan level.
- We may change pricing with notice.
5. Refunds & Disputes
- Refund requests are handled case-by-case.
- Disputes with Stripe charges must follow Stripe's dispute resolution process.
- Fraudulent activity may result in immediate termination.
6. User Content & Data
- You retain ownership of content uploaded to Swiftly.
- By using the service, you grant Swiftly a limited license to process, host, and transmit data solely for providing services.
- You are solely responsible for ensuring your use of Swiftly complies with all laws (e.g., telemarketing, data protection).
7. AI Agents & Communications Disclaimer
Swiftly provides AI-powered agents that may engage in voice and chat communications.
Users are solely responsible for the content of communications, compliance with privacy and marketing laws,
and disclosure to end-users that they are interacting with AI where required by law.
8. Prohibited Uses
You agree not to:
- Use Swiftly for unlawful activities, spam, harassment, or fraud.
- Circumvent platform fees, security, or access restrictions.
- Reverse-engineer or misuse integrations (including Stripe, GHL, etc.).
9. Liability & Disclaimers
Swiftly provides services "AS IS" without warranties of any kind. We are not liable for:
- Loss of data due to user error, third-party failures, or force majeure.
- Business losses (lost profits, opportunities).
- AI agent miscommunications, inaccuracies, or errors.
- Stripe payment processing errors.
Our maximum liability is limited to the subscription fees paid in the past 12 months.
10. Indemnification
You agree to indemnify and hold Swiftly harmless from claims, damages, or costs arising from:
- Your use of Swiftly in violation of these Terms.
- Breach of data protection or telemarketing laws by you or your customers.
- Misuse of AI agent conversations or communications.
- Disputes related to payments processed through Stripe.
11. Termination
We may suspend or terminate accounts for violation of Terms or misuse.
Upon termination, access to agents, data, and integrations will cease.
12. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania.
Any disputes shall be resolved through binding arbitration in Pennsylvania, except where prohibited by law.
13. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
